Terms of Use
The agreement
These Terms of Use (“Terms”) are a contract between you and Gini Health (“Gini,” “we,” “us”). They govern gini.health, the waitlist, founding membership, the Gini app (web, iOS and Android), connected wearables and health records, the AI advisor, Gini Care, and the Gini blood test (together, the “Services”). By using the Services, joining the waitlist, creating an account, or continuing to payment, you agree to these Terms and to our Privacy Policy, which explains how we handle your information and is incorporated here. If you do not agree, do not use the Services.
Where a Service is marked Coming soon in the Privacy Policy, the terms for it below apply from the day it becomes available to you.
Who can use Gini
You must be 18 or older and located in the United States to create an account or buy anything from Gini. Gini Care clinician services are available only in the US states where our clinicians are licensed; we tell you if yours is not yet one of them. Founding membership and the Gini blood test are limited to people assigned female at birth who are not pregnant and do not plan to be pregnant by our stated launch window; we may decline or cancel a reservation if these conditions are not met. Do not use Gini if you are pregnant or think you might be, unless a clinician tells you otherwise.
Your account
- Give accurate information and keep it current.
- Keep your password private, turn on two-factor authentication if you can, and tell us at once if you suspect unauthorised access.
- One account per person. Do not share accounts or use someone else’s data as your own.
- You are responsible for activity under your account until you tell us it has been compromised.
- You can delete your account at any time in Privacy & Compliance; the Privacy Policy explains what happens to your data.
What Gini provides
- Gini app. A place to see your own health data, lab results, cycle and symptom logs, journal, connected wearables and imported medical records, with explanations, trends and an AI advisor.
- Gini blood test. An at-home blood collection kit, laboratory analysis of the sample, and informational results and insights returned in the app. Results may be reviewed by a clinician for quality; that review is not a medical visit.
- Gini Care. An AI assistant grounded in your data when you allow it, a Symptom Radar that flags patterns for you to consider, and the option to add a licensed clinician who replies to you by secure messaging.
We work hard to keep the Services accurate and available, but we may change, suspend or discontinue any part of them, and we do not promise any particular feature, integration or partner connection will exist or keep working.
Not medical advice; emergencies
Gini’s app, blood test results, insights, Symptom Radar and AI advisor are informational and educational. They are not medical advice, diagnosis or treatment, and Gini is not a medical device. They do not create a doctor–patient relationship. Do not use them to diagnose or treat a condition, or to start, stop or change a medication or treatment, without talking to a clinician. AI replies can be wrong, incomplete or out of date; Symptom Radar can miss illness and can raise false alarms. Always keep a primary care relationship.
If you think you may have a medical emergency, call 911 (or your local emergency number) immediately. If you are in crisis or thinking about harming yourself, call or text 988. Gini is not an emergency service and does not monitor for emergencies. Our chat screens for some red-flag phrases and shows an emergency message, but that screening is not a safety net and you should never wait for it.
Clinician services and telehealth
Coming soon When you add a clinician in Gini Care, medical care is provided by independent licensed clinicians (or a medical practice engaged to provide care through Gini), not by Gini’s technology. Only a clinician’s reply to you is medical advice, and it is that clinician’s advice. Gini provides the platform: it does not practice medicine, employ clinicians in their clinical capacity, or control their professional judgement.
- Before your first clinician conversation you must read and accept a separate Telehealth Informed Consent. It is part of your agreement with us and with the clinician.
- Care is asynchronous messaging. Replies are targeted within the response window shown when you ask, during posted hours; it is not real-time care.
- You must be physically in a state where the clinician is licensed at the time of care, and you must tell us that state truthfully.
- Clinicians may recommend labs, and may issue prescriptions only where permitted and through a certified e-prescribing partner; controlled substances are never prescribed through Gini. Until an e-prescribing partner is live, a clinician may record a prescription intent for you to take to your own prescriber or the clinician’s own system.
- Clinician services may be charged separately; prices are shown before you commit.
Connected accounts and records
- Connecting a wearable, Apple Health, Health Connect, a health system, an insurer or Medicare is your choice and your authorisation. You confirm the account you connect is yours (or you are legally authorised to access it) and that you have the right to bring that data into Gini.
- Those providers have their own terms and privacy policies; we do not control them and are not responsible for their accuracy, uptime, or changes to their APIs. A connection can stop working if the provider changes or revokes access.
- You may disconnect at any time in Gini or at the provider; we then delete the data synced from that source as the Privacy Policy describes.
- Wearable and record data can be incomplete or wrong. Gini presents it as reported and is not responsible for errors that originate at the source.
- Strava data are used only for training volume, never to infer a health condition, as Strava’s API agreement requires.
Waitlist, membership and payments
Waitlist
Joining the waitlist asks us to email you about Gini. It is not a purchase and does not guarantee a kit, a launch date, or founding pricing.
Founding membership
Founding membership is a paid reservation for Gini’s annual plan at founding pricing, limited to our first 100 founding members. Payment is processed by Stripe. Your kit is intended to ship at our October 2026 launch; launch timing can move. The price shown before checkout is an estimate; tax is calculated at payment from your shipping address. Founding pricing is meant to continue through renewals for members who remain enrolled, as described on the site when you buy; we will tell you before a material change to that commitment. Founding reservations are fully refundable if you change your mind; email support@gini.health.
Subscriptions and other purchases
Gini may offer paid memberships, additional tests, and clinician visits. For each we will show the price, billing period, renewal terms and cancellation method before you pay, and those terms will apply along with these Terms. Unless stated otherwise at purchase: subscriptions renew automatically until cancelled; you can cancel any time and keep access to the end of the paid period; fees are non-refundable except as stated at purchase or required by law; and we may change prices for future periods with at least 30 days’ notice. Only clinician care and laboratory testing may be eligible for HSA/FSA reimbursement; check with your plan.
Acceptable use
You agree not to:
- Use the Services for anyone other than yourself, or enter another person’s health data without their authority.
- Break the law, infringe others’ rights, or upload harmful, abusive or deceptive content.
- Probe, scan, scrape, reverse-engineer or interfere with the Services, bypass security or rate limits, or access data you are not authorised to see.
- Use the AI to generate content that is unlawful, to obtain controlled substances, or to impersonate a clinician.
- Resell, sublicense or commercially exploit the Services or data obtained through them, including data from our partners.
- Misrepresent your identity, age, location or eligibility.
Your content and data
You own the information and content you enter or connect to Gini. You give Gini a limited, non-exclusive, worldwide, royalty-free licence to host, process, display and transmit it solely to provide the Services to you, to keep them secure, and as the Privacy Policy describes. That licence ends when the data is deleted, except for the retention the Privacy Policy explains. We may use aggregated, de-identified statistics to improve Gini and to publish research; they will never identify you.
Intellectual property
The Services, including software, text, graphics, the Gini name and logo, algorithms, Symptom Radar and the design of our reports, are owned by Gini Health or its licensors and protected by intellectual property laws. We grant you a personal, limited, revocable, non-transferable licence to use the Services for your own health. Nothing here transfers any ownership to you. If you send us ideas or feedback, we may use them without obligation to you.
Third-party services
Oura, WHOOP, Fitbit, Google, Garmin, Withings, Polar, Dexcom, Strava, Apple, Epic, Oracle Health, Medicare and the other names in our app belong to their owners. Gini is an independent company; none of them sponsors or endorses Gini, and their trademarks are used only to identify the connection you are making. Your use of their products is governed by their terms.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, GINI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT RESULTS, INSIGHTS OR AI REPLIES WILL BE ACCURATE, COMPLETE, TIMELY OR SUITED TO YOUR SITUATION. LABORATORY RESULTS ARE SUBJECT TO THE LIMITS OF THE TESTING METHOD AND SAMPLE QUALITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. This does not limit the responsibility a clinician has to you under the law for care they provide.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GINI HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID GINI IN THAT PERIOD OR ONE HUNDRED US DOLLARS ($100). Some states do not allow certain limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, wilful misconduct, or a clinician’s professional liability for care.
Indemnity
You agree to defend and indemnify Gini against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of law or of someone else’s rights.
Termination
You may stop using Gini and delete your account at any time. We may suspend or end your access if you breach these Terms, create risk or legal exposure for us or others, or if we discontinue a Service, with notice where practical. Provisions that by their nature should survive, including your content licence for retained data, disclaimers, limitation of liability, indemnity and governing law, do survive.
Governing law and disputes
These Terms are governed by the laws of the State of Connecticut and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to email support@gini.health describing the issue and to give us 30 days to try to resolve it informally. If we cannot, claims will be brought in the state or federal courts located in Connecticut, and you and Gini consent to their jurisdiction, except that either party may seek relief in small-claims court where eligible or injunctive relief to protect intellectual property. To the extent permitted by law, each party waives the right to a jury trial and to participate in a class action. Claims must be brought within one year of when they arose, unless the law provides a longer period that cannot be shortened. Clinician malpractice claims are governed by the law of the state where care was provided.
Changes to these terms
We may update these Terms. We will post the new version here with a new effective date, and for material changes we will notify you in the app or by email at least 14 days before they take effect. Continuing to use the Services after that date means you accept the new Terms; if you do not, stop using the Services and delete your account.
General
These Terms, the Privacy Policy, the Telehealth Informed Consent (when you accept it) and any purchase terms shown at checkout are the entire agreement between you and Gini about the Services. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Notices to you may be sent to the email on your account.
